Terms of Service

Welcome to Pops! These Terms of Service (“Terms”) govern your use of Pops, operated by Undefined Software, Inc.(“we,” “us,” or “our”).
By using Pops, you agree to these Terms. If you don't agree, please don't use Pops.
1. Using Pops
Eligibility
You must be at least 13 years old to use Pops. If you're under 18, you should have your parent or guardian review these Terms with you.
By using Pops, you represent that you meet these age requirements and have the authority to agree to these Terms.
Your Account
To use certain features of Pops, you'll need to create an account. You're responsible for:
- Keeping your account credentials secure
- All activity that happens under your account
- Not sharing your account with others
- Notifying us immediately if you suspect unauthorized access
You may not create accounts for anyone else without their permission, or create multiple accounts to circumvent restrictions or bans.
Acceptable Use
Pops is a creative platform for building and sharing interactive experiences. We trust you to use it responsibly.
You agree not to:
- Violate any laws or regulations
- Infringe on others' intellectual property or privacy rights
- Harass, bully, threaten, or harm others
- Impersonate others or misrepresent your affiliation with anyone
- Spam, phish, or engage in other deceptive practices
- Interfere with or disrupt Pops's functionality or security
- Attempt to access others' accounts or private data
- Use automated systems (bots, scrapers) without permission
2. Content
Your Content
When you create and publish Pops or other content on our platform, you retain ownership of your work. However, you grant us certain rights to make the service work.
By posting content to Pops, you grant us a worldwide, non-exclusive, royalty-free license to:
- Host, store, and display your content
- Distribute your content to other users through the feed and share features
- Make technical modifications (like formatting or resizing) necessary to display your content
- Allow other users to view and interact with your content
This license ends when you delete your content, except for copies that:
- Other users have saved or shared
- Are retained in backups (which are periodically deleted)
- We must keep for legal reasons
Content You Create
You are responsible for the Pops and content you create. This means:
- You own or have permission to use any code, images, text, or other materials in your Pops
- You have the right to grant us the license described above
- Your content doesn't violate these Terms or applicable laws
Prohibited Content
Don't create or share content that:
- Contains hate speech, promotes discrimination, or attacks individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Is sexually explicit, pornographic, or inappropriate for minors
- Depicts or promotes violence, self-harm, or harm to others
- Infringes on copyrights, trademarks, or other intellectual property rights
- Contains malware, viruses, or malicious code
- Is designed to deceive users (phishing, scams, fraud)
- Violates someone's privacy by sharing personal information without consent
- Is illegal in any way
We reserve the right to determine what violates these standards.
Third-Party Content
If your Pop includes third-party content (like images, music, or code), you must:
- Have permission to use that content
- Comply with any license terms or attribution requirements
- Not claim ownership of work that isn't yours
You're responsible for ensuring you have the rights to use any third-party content in your creations.
Other Users' Content
You may interact with content created by other users. When you do:
- You don't acquire any ownership rights to their content
- You can't copy, reproduce, or redistribute their content outside Pops without permission
- You should respect their intellectual property and creative work
Pops doesn't endorse any user-generated content and isn't responsible for what others create or share.
3. Content Moderation
Reporting
If you see content that violates these Terms, please report it using the report button available on each Pop. We review all reports and take appropriate action.
Removal
We may remove content or suspend accounts that violate these Terms, without notice and at our sole discretion. This includes:
- Content that violates our prohibited content policies
- Spam or misleading content
- Content that infringes intellectual property rights
- Content reported by rights holders (DMCA takedowns)
We'll try to notify you if we remove your content, but we're not obligated to do so.
Appeals
If you believe we removed your content or suspended your account in error, you can contact us at alon@undefinedinc.io to request a review.
4. Intellectual Property
Our Rights
Pops, including its design, features, code, and branding, is owned by Undefined Software, Inc. and protected by intellectual property laws. You may not:
- Copy, modify, or reverse engineer any part of Pops
- Use our trademarks, logos, or branding without permission
- Create derivative works based on Pops
- Frame or mirror any part of the service
Copyright Infringement
We respect intellectual property rights and expect our users to do the same.
If you believe content on Pops infringes your copyright, please email us at alon@undefinedinc.io with:
- A description of the copyrighted work you claim was infringed
- The location of the allegedly infringing content on Pops
- Your contact information
- A statement that you have a good faith belief the use is unauthorized
- A statement under penalty of perjury that your notice is accurate and you're authorized to act on behalf of the copyright owner
- Your physical or electronic signature
We'll investigate and take appropriate action, which may include removing the content.
Repeat Infringers
We'll terminate accounts of users who repeatedly infringe others' intellectual property rights.
5. Disclaimer of Warranties
Pops is provided “as is” and “as available” without warranties of any kind, either express or implied.
We don't guarantee that:
- Pops will always be available, uninterrupted, or error-free
- Any content will be accurate, complete, or reliable
- Defects will be corrected
- Pops is free from viruses or harmful components
You use Pops at your own risk. We're not responsible for:
- Loss of data or content
- Issues caused by user-generated content
- Technical problems or bugs
- Incompatibility with your device or software
6. Limitation of Liability
To the maximum extent permitted by law, Undefined Software, Inc. and its officers, directors, employees, and agents will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or opportunities
- Damages resulting from your use or inability to use Pops
- Damages caused by user-generated content
- Any other damages exceeding $100 USD
This limitation applies even if we've been advised of the possibility of such damages.
Some jurisdictions don't allow these limitations, so they may not apply to you.
7. Indemnification
You agree to indemnify, defend, and hold harmless Undefined Software, Inc.from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of Pops
- Content you create or share
- Your violation of these Terms
- Your violation of any rights of others
8. Changes to Pops
We're constantly improving Pops. This means we may:
- Add, modify, or remove features
- Change how the service works
- Update these Terms
We'll notify you of significant changes through the app or via email. Your continued use of Pops after changes means you accept the updated Terms.
We may also suspend or terminate Pops entirely, with or without notice.
9. Termination
By You
You can stop using Pops and delete your account at any time through the app settings.
By Us
We may suspend or terminate your access to Pops if:
- You violate these Terms
- Your conduct harms other users or Pops
- We're required to do so by law
- We discontinue the service
We'll try to give you notice before terminating your account, but we're not obligated to.
Effect of Termination
When your account is terminated:
- Your access to Pops ends immediately
- Your personal information will be deleted according to our Privacy Policy
- Your Pops may remain visible showing “deleted account” as the creator
- These Terms continue to apply to your past use of the service
10. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
Informal Resolution
If you have a dispute with us, please contact us at alon@undefinedinc.io first. We'll try to resolve it informally.
Arbitration
If we can't resolve the dispute informally, you agree that any disputes will be resolved through binding arbitration rather than in court, except:
- Small claims court cases (under your local small claims court limit)
- Disputes about intellectual property rights
- Requests for injunctive relief
Class Action Waiver
You agree to resolve disputes with us on an individual basis. You may not bring claims as part of a class action, collective action, or representative proceeding.
11. General Terms
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Undefined Software, Inc. regarding Pops.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
No Waiver
Our failure to enforce any provision doesn't waive our right to enforce it later.
Assignment
You may not transfer your rights under these Terms. We may transfer our rights to any affiliate or successor.
Force Majeure
We're not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, wars, internet outages, etc.).
